Special Education

The Americans with Disabilities Act of 1990 prohibits discrimination by state and federal government services solely on the basis of a disability. The Individuals with Disabilities Education Act of 1997 further expands the rights of students with disabilities. Indiana special education rules require that all students with disabilities, enrolled in a public school, be provided with a free, appropriate public education. As a result, special education services are provided at no extra cost and in ways that offer all students equal access to activities.

If a child has special education needs, your school should provide help or point the student and family to the appropriate resources. The first step is to know what help a student requires. Has the student been tested and identified as having a learning or physical disability? Some students needs may be met with homework help or by transferring to a different level class.

Special education and related services must be provided in the least restrictive environment (LRE). LRE means that a student with a disability participates in classes with students without disabilities as much as possible.

A student who may need special education will have a Case Conference Committee (CCC) composed of school personnel and parents. The CCC decides whether a student is eligible for special education and what education and related services will be provided, based on students needs.

Individualized Education Program (IEP) is a document developed by members of the CCC. Among other things, an IEP describes any accommodations or modifications in the general education environment, and any special education and related services the student needs. An IEP must be reviewed and updated by the CCC at least every 12 months.
